Brazil  which changed the ANATEL homologation process.Then it was amended by Ato No.5701 on July 29, 2021, which postponed the implementation date for importation requirements to 2 years instead of the 1 year previously published. Now, on July 30, 2022, all the products imported to Brazil must receive ANATEL approval before the importation in Brazil, Except the product below:

– Unfinished products that will be embedded to finish products in Brazil.

– Products that will have its identification in Brazil by mint labels.

– Products that will be for own´s use (not commercialized)

– Products designed for medical applications that are under ANATEL and  ANVISA laws.

In analyzing the situation, ANATEL decided to extend this deadline to October 31, 2022, publishing in an official note 265/2022/ORCN/SOR

The inspection was coordinated by Moisés Moreira, Anatel’s advisor, and by the Superintendent of Inspection, Hermano Tercius, with the support of Direp (Division for Reprimanding Smuggling and Embezzlement of the Federal Revenue Service of Brazil) and PFE-Anatel (Federal Prosecutor’s Office Specialized with Anatel )

In a statement, Amazon told Tilt that it “received tax from Anatel at two of its distribution centers between June 21 and 24. Amazon is currently working on the information in cooperation with the authorities and, as necessary, will take action in the interests of of consumers.”

Combat piracy

Anatel’s operation is part of actions to combat irregular trade in non-approved products. That is, without registration of the agency. The approval is made to authorize the sale of a product in the Brazilian market. The process is necessary to ensure that the products do not pose risks to consumers and to guarantee service by a technical assistance in case of defects. Before an electronic device is sold, it undergoes a series of tests to evaluate potential, for example, overheating, explosion, radiation, interference with other communication signals, among other problems. In general, when a non-approved product is sold over the internet, it is sold at prices much lower than the others practiced in the market, which can attract the consumer. Many people, however, do not even realize that the sale of this product is illegal.

Keeping an eye on irregular cell phones

In recent years, Anatel has intensified enforcement against the sale of illegal smartphones.

Its Action Plan to Combat Piracy (PACP) has existed since 2018. Until last year, together with other bodies, operations prevented the sale of 4.6 million irregular products with a total value estimated at R$500 million.

To introduce an updated version of the Testing Standard for Low Power Devices (SRD)

The key points for this update are as follows:

• New Test Standard for Low Power Devices (SRD): ENACOM-Q2-60.14 V21.1

o It has been in effect since March 8, 2022

o Replaced the old standard ENACOM-Q2-60.14 V20.1

o New SRD low frequency bands have been added:

• 0.490 – 1.705 MHz
• 1.705 – 30 MHz
• ENACOM granted a grace period of 90 calendar days to allow new and ongoing applications to still be accepted with reports issued under the old ENACOM-Q2-60.14 V20.1 standard.
• For renovations, based on the old Res. 552/2021, it would not be necessary to retest, as long as the original test report demonstrates that it complies with the limits established in this new regulation.
• New Test Standard for Low Power Devices (SRD): ENACOM-Q2-60.14 V21.1

1.1. Authorize the performance of the certification maintenance activity only with the presentation of the statements necessary to carry out the certification process, with the presentation of internal and external photos of the product and test reports applied to the current maintenance period being waived.

1.1.1. The waiver in question will be given upon presentation of the declaration of the applicant for certification, stating the difficulty of having these documents due to the pandemic.

1.1.2. We emphasize that the waiver covers any other documents that are necessary to carry out the maintenance, with the exception of statements applied to the current maintenance period.

1.1.3. If there is a change in the product and/or technical requirements applied to it and the applicant took advantage of this extraordinary condition in a maintenance, the documents and tests relevant to the product must be presented in the subsequent maintenance.

1.1.4. The exemption from the presentation of the test report does not apply to products that failed during the tests in the last conformity assessment. 1.2. It is exceptionally authorized to carry out remote audits by OCDs in manufacturing units and testing laboratories, replacing face-to-face audits, as well as remote monitoring of the performance of tests in laboratories that are not accredited or evaluated by third parties.

1.2.1. Therefore, the OCD must be properly prepared to record the meeting on video and keep documented all the actions and records necessary to ensure reliability in carrying out such activities remotely.

1.2.2. It is worth mentioning that the audits and the follow-up of the tests must be carried out by OCD specialists duly recognized by Anatel.

2. The temporary and alternative conditions established in item 1.1 of this Official Letter apply only to the product whose validity period of the Certificate of Conformity runs until the date of July 31, 2022. The same date applies to audits and test monitoring remotes.
3. Exceptional situations not covered by the conditions specified above will be evaluated by this Management (ORCN).
4. This Official Letter replaces all others previously issued and dealing with the subject in question.

At this moment, SUBTEL has announced that the deadlines for issuing the certificates will be affected, but expects to have the situation solved as soon as possible.

Radio Base Transceivers for Mobile Communication Services (ENACOM-Q2-61.04 V17.1)

This accreditation revoked the use of Declarations of Conformity and triggered the application of mandatory local testing on medical devices and radio base transceivers, while for user cellular terminals (*) local testing would only become mandatory when international certification is not available.

This resolution established a 180-day adaptation period, so local testing will apply from March 2022 (Feb. 28, 2022).

The effects of the key posts for each device type are as follows:

Medical devices

As of March 2022, the Declaration of Conformity established in Res.863/2020 will no longer be accepted to waive local testing. 

Local testing would be mandatory for new/renewable applications based on the ENACOM-Q2-60.15 V19.1 testing standard.

Applicable to the following technologies/band: 

Inductive telemetry (9-315kHz)

MICS/MEDS (401-406MHz)

RF (30-37.5MHz)

Endoscopy capsule (430-440MHz)

User Terminals for Mobile Communication Systems 

As of March 2022, the Declaration of Conformity established in Res.793/2019 will no longer be accepted to waive local testing on cellular terminal devices, as two (2) laboratories are already accredited.  

The never repealed Resolution 4709/2018 remains effective, still allowing International Certification + RF Reports such as FCC/ANATEL/IFT/CE) to waive local testing. 

Local testing would be mandatory or new/renewed applications based on ENACOM-Q2-61.03 V17.1 only for cases where there are no International Certification & RF Reports available for the assigned bands willing to be registered.

Applicable to the following technologies/bands: 

2G – GSM/EDGE (850/1900MHz)

3G – WCDMA (850/1900MHz)

4G – LTE (BB4, B7, B8, B28, B10, B38)

Mobile Communication Services Radio Base Transceivers

As of March 2022, the Declaration of Conformity established in Res.794/2020 will no longer be accepted to waive local testing. 

Local testing would be mandatory for new/renewed applications of Radio Base Transceivers based on the ENACOM-Q2-61.04 V17.1 testing standard.
